GotGrifted, LLC owns all rights to the original content created for this Platform, including but not limited to:
- Articles, guides, and educational materials
- Templates, forms, and downloadable resources
- Website design, graphics, and visual elements
- Software, code, and technical infrastructure
- Logos, trademarks, and brand elements
- Compilations and arrangements of content
Prohibited Uses
Without prior written permission from GotGrifted, LLC, you may NOT:
- Copy, reproduce, or distribute our content for commercial purposes
- Modify, adapt, or create derivative works from our content
- Remove copyright notices or attribution from any content
- Use our content to train AI or machine learning models
- Scrape, harvest, or systematically collect our content
- Frame, mirror, or republish our Platform or content
Permitted Uses
You MAY use our content for:

User-Submitted Content
Users retain ownership of the original content they submit (their stories, experiences, and descriptions). By submitting content, users grant GotGrifted a license as described in Section 5 (User Content License). User-submitted content remains the intellectual property of the submitting user.
Copyright Complaints (DMCA)
If you believe content on the Platform infringes your copyright, please submit a DMCA notice via our contact form with: (1) identification of the copyrighted work, (2) identification of the infringing material and its location, (3) your contact information, (4) a statement of good faith belief, and (5) a statement under penalty of perjury that you are authorized to act on behalf of the copyright owner.
4. Platform Status and Liability Limitation
GotGrifted is an interactive computer service provider that enables consumers to share their experiences. GotGrifted does not create, author, endorse, or verify the accuracy of user-submitted content.
Under Section 230 of the Communications Decency Act (47 U.S.C. Section 230), GotGrifted is not the publisher or speaker of any content submitted by users. Users who submit content are solely responsible for their submissions.
We may, but are not obligated to, monitor, edit, or remove content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable. Our decision to take or not take any such action does not transform us into the publisher of such content.
Individual stories and experiences shared on this Platform are separate from and not endorsed by GotGrifted, LLC. Each user is solely responsible for the content they submit.
5. User Content License
By submitting content to GotGrifted, you grant GotGrifted, LLC a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to:
- Publish, display, and distribute your submission
- Store, reproduce, and archive your submission
- Create derivative works (formatting, excerpts) for platform operation
- Sub-license these rights to service providers (hosting, CDN)
You retain all ownership rights in your original content. This license is limited to operating and promoting the GotGrifted platform and consumer advocacy purposes.
6. User Representations and Warranties
By submitting content, you make the following legally binding representations. GotGrifted relies on these representations in publishing your content.
Truthfulness
All statements of fact are true and accurate to the best of your knowledge. You understand that false statements may constitute defamation and may expose you to legal liability.
Firsthand Knowledge
You have direct, personal knowledge of the events you describe, or you clearly identify information obtained from other sources.
No Defamation
Your submission does not contain knowingly false statements of fact made with actual malice (knowledge of falsity or reckless disregard for the truth).
Right to Share
You have the legal right to share all information in your submission. Your submission does not violate any confidentiality agreement, protective order, or other legal restriction.
No Impersonation
You are submitting under your own identity (or an authorized pseudonym) and are not impersonating another person.
Age Requirement
You are at least 18 years of age or the age of majority in your jurisdiction.
Breach of these warranties may result in content removal and termination of your access to the Platform.
7. Indemnification and Release
RELEASE OF LIABILITY
By submitting content to the Platform, you acknowledge and agree that:
- Your content will be published publicly and may be viewed by anyone on the internet
- Third parties may read, share, comment on, or take action based on your published content
- GotGrifted has no control over how third parties respond to or use information in your published content
YOU HEREBY RELEASE AND HOLD HARMLESS GOTGRIFTED, LLC FROM ANY AND ALL LIABILITY ARISING FROM THE ACTIONS, RESPONSES, OR CONDUCT OF THIRD PARTIES IN CONNECTION WITH YOUR PUBLISHED CONTENT, INCLUDING BUT NOT LIMITED TO:
- Any contact, communication, or interaction initiated by third parties who view your content
- Any legal action, demand, or claim brought against you by persons or entities mentioned in or responding to your content
- Any business, employment, or reputational consequences resulting from the publication of your content
- Any harassment, threats, or other conduct by third parties directed at you or others as a result of your content
Assumption of Risk
You understand and voluntarily assume all risks associated with publishing your content on the Platform, including the risk that third parties may disagree with, dispute, or take legal action regarding statements in your content. You are solely responsible for ensuring that your content is truthful and does not violate the rights of others.
Indemnification
You agree to defend, indemnify, and hold harmless GotGrifted, LLC, its officers, members, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your submission of content to the Platform
- Any claim that your content violates the rights of any third party, including defamation, invasion of privacy, or intellectual property claims
- Your breach of any representation or warranty in these Terms
- Your violation of any applicable law in connection with your use of the Platform
- Any actions taken by third parties in response to your published content
This indemnification obligation shall survive termination of your use of the Platform.
8. Limitation of Liability and Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
GotGrifted does not warrant that: (a) the Platform will be uninterrupted, secure, or error-free; (b) user-submitted content is accurate, complete, or reliable; (c) any particular outcome will result from sharing your story.
IN NO EVENT SHALL GOTGRIFTED, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOTGRIFTED'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).
9. Dispute Resolution
Binding Arbitration
Any dispute, claim, or controversy arising from or relating to these Terms or your use of the Platform shall be resolved exclusively through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.
The arbitration shall be conducted in Clackamas County, Oregon, or at a location mutually agreed upon. The arbitrator's decision shall be final and binding. Judgment on the award may be entered in any court of competent jurisdiction.
CLASS ACTION WAIVER
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against GotGrifted, LLC.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles.
Small Claims Exception
Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
10. Content Moderation and Removal
GotGrifted reserves the right, but not the obligation, to:
- Review submissions before or after publication
- Refuse to publish any submission for any reason
- Remove or edit content at any time, with or without notice
- Terminate or suspend access for users who violate these Terms
This moderation does not make GotGrifted the publisher of user content. We exercise this discretion as a neutral platform service.
Removal of content does not constitute an admission that such content violated any law or these Terms.
11. Acceptable Use Policy
You agree NOT to submit content that:
- Contains knowingly false statements of fact
- Constitutes harassment, threats, or incitement to violence
- Includes personal information of third parties without their consent
- Contains obscene, pornographic, or sexually explicit material
- Infringes intellectual property rights
- Contains malware, viruses, or harmful code
- Violates any applicable law
GotGrifted may report illegal activity to law enforcement and cooperate with legal investigations.
12. Modifications to Terms
GotGrifted reserves the right to modify these Terms at any time. Material changes will be posted with an updated "Last Updated" date. Continued use of the Platform after modifications constitutes acceptance of the new Terms.
For previously submitted content, the Terms in effect at the time of submission shall govern that content.
